Landmark Legislation and Litigation

“We would not have
hemp legalization without Courtney….”

Oregon Senator Ron Wyden

EARTH Law, LLC

EARTH Law, LLC was founded by Courtney N. Moran, LL.M. with the goal of lifting the federal ban on hemp in the United States and making it a legal and accessible agricultural commodity for farmers and processors.

In 2018, several landmark legal and legislative victories helped pave the way for industrial and agricultural hemp in the US.

2018 Federal Farm Bill

The end of hemp prohibition!

Over the past two years working with the offices of Senator Ron Wyden and Senate Majority Leader Mitch McConnell, we drafted the Hemp Farming Act of 2018 the full language of which was eventually included in the 2018 federal Farm Bill.

Unwritten benefits provided for are access to banking and full plant organic certification.

Transportation of Agricultural Hemp

Interstate transportation has been a long-standing issue with hemp. In the cases below, Courtney N. Moran, LL.M. made significant progress paving the way for legal, efficient interstate hemp transportation.

Case: KaB, LLC v USPS, MLB 18-39 (2018)

For first time in history the Judicial Officer and the Federal Court for the U.S. Postal Service has cleared the way for the shipment of agricultural pilot program industrial hemp, specifically CBD derived from pilot program industrial hemp, through the U.S. Postal Service.

Case: RNF, LLC v. USPS, MLB 18-113 (2018)

In December 2018, EARTH Law, LLC’s founding principal, Courtney N. Moran LL.M., successfully set precedent for Shipment of Viable Hemp Seed through the United States Postal Service.

“Congress expressly permits the transportation of exempt industrial hemp, including the seeds thereof.” – Judge James G. Gilbert
